Digi Terms and Conditions of employment

Not many companies willing to share their Terms of Employment to the whole world. But Digi Malaysia has thought differently when we talk about the T&C.

I believe unlike other companies Digi got nothing to hide and of course very confident on their action.

We made it a point to share with you what we give and expect from our people. This is the actual document which our employees receive upon joining DiGi.

We believe in doing things simply and smartly. We believe in building diversity in all aspects of our employment, nad in treating all our employees fairly. We believe in encouraging top performance and high commitment and engagement from you. We obey all laws and regulations, both in letter and in spirit. We take our role as a productive and positive corporate citizen of Malaysia seriously. We expect you to believe and do the same.

You’ll work with DiGi under these terms and conditions:

Your Probationary Period
You’ll need to serve probation for 6 months, and complete it successfully in order to be confirmed and continue employment. If you don’t complete that period successfully (or an extension of up to 3 months if you are given one), you may be terminated from employment.

You’ll Need To Take and Pass a Medical Examination
You’ll need to do this before joining the Company. It’ll be at a clinic or hospital appointed and paid for by the Company.

How To Terminate Your Employment
You or the Company may terminate your employment at any point by giving one week’s notice (if you’re still under probation, including extension if any), or two months’ notice if you’ve been confirmed. Or you may pay the equivalent amount of salary in lieu of giving notice. You may also do a combination of both.

If you’re under a fixed term contract, your notice period after confirmation will be one month instead of two months.

Employee Provident Fund (EPF)
The Company’ll contribute to the EPF according to the EPF provisions currently in force. The Company’ll also make deductions from your applicable income.

Enhanced EPF Contributions (EEPF)
The Company’ll contribue an 3% of your basic monthly salary to the EPF like this:
You’ll be eligible for this immediately upon joining the Company
However, the contributions will be withheld until you complete three years of service with the Company or upon expiry of your employment contract
Then the amount withheld (including the dividend added to it in line with what the EPF declared during that period) shall be remitted to the EPF
From that point owards, the Enhanced EPF contributions shall be made every month direct to the EPF
(Note: If you leave the Company for whatever reason within that 3 year period or before the expiry of your employment contract, you’ll forfeit the amount, including dividend withheld)

Social Security (SOCSO)
the Company’ll contribute to SOCSO in accordance with the SOCSO provisions. The Company’ll also make deductions from your applicable income. Even if you are not required to contribute SOCSO, you may choose to do, but according to SOCSO rules,”once in always in”.

Taxes
You’ll be responsible for any personal income taxes which may be payable, and any other dues and levies payable in relation to the performance of this Contract. DiGi reserves the right to deduct from your salary for the amount due to you in compliance with the requirement of the Malaysian Inland Revenue Department.

Working Hours, Days
You’ll work Monday to Friday from 9:00am to 6:00pm. You’ll have one hour off for lunch. (If you’re a male Muslim you may take reasonable additional time off to do your Friday prayers). Saturday shall be the “Off Day”, and Sunday the “Rest Day”.

Alternatively, depend on which state you’re employed in, you may work Saturday to Wednesday, same hours. Thursday shall be the “Off Day”, and Friday the “Rest Day”.

If your non working days fall on other days, the last non working day will be your “Rest Day” and the rest will be your “Off Day/s”.

Depending on the nature of your job and the needs of the Company, you may be assigned different working days and hours.

If you are covered by the Employment Act,you’ll be paid for working extra hours in accordance to the Act. If you are earning above RM1,500, you will be paid according to Company policy for such work.

Public Holidays
You’ll enjoy all public holidays gazetted by the federal government, as well as any other ublic holidays gazetted by the state government of the state you’re working in.

Your Salary Increment
Your salary may be increased from time to time at the Company’s discretion.

Your Bonus
You may be given a bonus from time to time at the Company’s discetion. You’ll still need to be in employment when the bonus is paid out for you to be eligible for it.

Your Paid Annual Vacation Leave
You’ll get 20 days of annual vacation leave per year of service.

You can only keep a maximum of 30 days of annual leave balance at any time (equivalent to unused annual leave over one and a half years). If the balance exceeds 30 days, the excess leave will be automatically forfeited without you being told.

You may apply for annual leave at any time if you have sufficient balance to cover the days you’re applying for.

——These Provisions for Maternity Apply to Female Employees Only —————

Maternity Leave (applies only if upon delivery you have no more than 5 surviving children)
You may take 60 consecutive days of paid leave.

Enhanced Maternity Leave (Optional)
You can go for an additional 60 days of Enhanced Maternity Leave at half pay. However, you must apply for this leave one month before going on maternity leave.

Maternity Benefit
You may claim RM2,000 as Maternity Benefit upon delivery.

Special Leave
You may apply for these special leave types
5 days for birth of your child ( only for male employees, in a legal marriage), beginning on the day of the delivery
5 days in the event of the death of your spouse, child or parent and parent-in-law
3 days in the event of the death of your brother, sister or grandparents
5 days in the event of your first legal marriage whilst with the Company
3 days ifyour house is directly hit and damaged by natural calamity (such as fire or natural disasters)

These days include working and non working days. These leave must also be used immediately, and may not be deferred or paid out in cash. The leave for natural calamity cannot exceed a total of 10 working days per year.

Medical Benefits
If you ‘re sick, and with valid medical certificate, you may take these paid days as sick leave
22 days in a calendar year if you are not hospitalized
If you are hospitalized, you may take 38 days of paid hospitalization leave per calendar year. (The 22 days above, or parts of ti , may also be used for hospitalization leave, if you haven’t used them up for non-hospitalization medical leave)

Medical Consultation and Treatment for You and Your Dependents
You, your spouse and children (aged below 21 years) are eligible for Company-paid medical consultation and treatment, and where necessary, specialist consultation and treatment at Company’s panel doctors or specialists in line with applicable Company policy.

Hospitalization and Surgical Treatment for You and Your Dependents
You, your spouse and children (aged below 21 years) are eligible for Company-paid hospitalization and surgical consultation and treatment at Company’s panel clinics/hospitals in line with applicable Company policy.

Dental Benefits for You and Your Dependents
You, your spouse and children (aged below 21 years) are eligible for Company-paid dental treatment at Company’s panel clinics/hospitals in line with current Company policy.

You’re Eligible for Prolonged Illness Leave
If you’re diagnosed with a serious illness (as defined by the applicable Company policy) and a doctor appointed by the Company certifies that you can’t work, and if you have used up all your medical, hospitalization and annual leave, then you may apply for Prolonged Illness Leave, which are
The first six months at full basic salary
The next six months at half basic salary
The next six months at no pay

At the end of the Prolonged Illness Leave (or at any point during it), the Company may conduct a review to determine your suitability for continuing employment.

If You Become Disabled
If you become disabled due to disease or accident, the Company will try to find a suitable job for you. If you’re offered such a job, it will be at a salary and terms and conditions at the discretion of the Company.

Your Insurance Coverage
If you die due to accident, your beneficiaries will receive 72 times of your last drawn monthly basic salary. If you’re permanently disabled due to accident, you’ll receive up to 72 timesof your last drawn monthly basic salary in accordance tothe terms of your coverage.

If you die due to natural causes, your beneficiaries will receive 36 times of your last drawn monthly basic salary. If you’re permanently disabled due to natural causes, you’ll receive up to 36 times of your last drawn monthly basic salary in accordance to the terms of your coverage.

Your Retirement Age
You’ll be required to retire on reaching the age of 55 years. Where your birthday is not stated in your identity card or birth certificate, you’ll retire on the 31st of December of the year you turn 55.

You May Be Transferred
You’re subject to transfer or relocation from one work unit or location within the Company to another. You’ll also be subject to such transfer or relocation to another associated or affiliated company or tot the Company’s Holding Company.

You and the Comapny’s Code of Conduct
Any Code of Conduct issued by the Company shall become part of these Terms and Conditions of Service.

The Company May change These Terms and Conditions
The Company reserves the right to change, annul, modify or vary any of the above and when it deems necessary.

General Matters
You must obey and comply with all orders and directions given by the Company, and follow all rules, regulations, procedures and practices.

You must not commit any misconduct or willful neglect whilst doing your job.

You must not be convicted of any offence that in the opinion of the Company affects your job with the Company.

You must not breach any of the terms and conditions of service contained inside here or elsewhere. If you breach any of the above, it may be considered as grounds to terminate your service without notice or payment of salary in lieu. You may also be terminated of your employment if you become unsound of mind.

All the matters listed here are covered in greater details in the Company’s policies. You must read the provisions here together with those policies.

In case of disputes, the provisions here shall be interpreted under applicable Malaysians laws.
